Land paperwork has a reputation for being intimidating. It doesn’t have to be. Once you know the handful of questions to ask, the process becomes calm and logical. Let’s walk through the main ideas in plain English, and then hand you over to a good advocate for the details.
This is chapter eight of our series. If you want the big picture first, read why farm land near Nagpur.
The big idea: agricultural land is regulated land
In Maharashtra, agricultural land is governed by tenancy and agricultural land laws, along with the Maharashtra Land Revenue Code. Vidarbha, the region that includes Nagpur, has its own historical versions of some of these laws. That means the rules about who may buy agricultural land, how much and for what use deserve real attention.
Five questions to ask about any farm land purchase
- Who is allowed to buy? Historically, Maharashtra has restricted purchases of agricultural land to people who qualify as agriculturists, with specific exceptions and permissions. Ask your advocate how the current rules apply to you and to the specific land.
- What is the land’s classification and use? The 7/12 extract (satbara) and related records show who holds the land, its type of holding and current use. A buyer should confirm that the land is agricultural and understand any restrictions attached.
- Is the title clean? Check the chain of ownership, mutation entries, encumbrances and any pending disputes.
- What can I build? A farmhouse on agricultural land is subject to local planning norms. Ask what is permitted, what approvals are needed, and what applies near forest areas.
- Is there anything special about the location? Land near a reserve may fall under buffer or eco-sensitive zone rules. See our corridor article for why this matters.
Minimum plot sizes and fragmentation
Maharashtra has laws aimed at preventing agricultural land from being fragmented into very small pieces. These rules can affect how a large parcel is divided and sold, which is one reason well-planned projects pay careful attention to structure and documentation. Ask any seller how the parcel has been legally divided and what approvals exist.
Laws change: a recent example
A Maharashtra amendment to the tenancy and agricultural lands laws, aligning them with the amended Land Revenue Code, took effect on 15 April 2026. According to a law-firm summary, it deals largely with land acquired for bona fide industrial use (including conversion premium and time limits for starting use), and removes the older nazarana fee on certain transfers. It’s a good reminder that rules evolve, and that your advocate should check the current position on the day you buy.
Tax basics (in one paragraph)
Agricultural income is generally exempt from income tax, but whether your land is “rural agricultural land” for capital gains purposes depends on its distance from municipal limits and the population of that municipality. Rent from a farmhouse is typically a separate matter. A chartered accountant can tell you exactly where you stand. See also our rental income guide.
Stamp duty, registration and other costs
Budget for stamp duty, registration fees, legal fees, taxes and any applicable charges on top of the land price. Our sales quotes note that taxes, stamp duty, registration and maintenance may be extra, and final figures should always be confirmed in the written agreement.
